What you need to know

The three criteria for entry into the Commercial Court are:

 

  • The dispute must be commercial in nature — this has been interpreted broadly by the judges

 

  • The value of the claim must be at least €1 million

 

  • There must have been no delay in seeking entry — even a delay of a few weeks has been held to be too long

What is the Commercial Court?

The Irish Commercial Court is a specialist division of the High Court, established to resolve significant business and commercial disputes quickly and efficiently. Unlike standard High Court proceedings, which can take years, cases admitted to the Commercial List are frequently resolved within weeks or months. The Court is actively case-managed by judges with extensive trial and business expertise, ensuring tight timelines for pleadings, discovery, witness statements, and hearing dates.

The no-delay rule

The requirement for no delay is the criterion most often overlooked — and the one most strictly enforced. Judges have refused entry to cases delayed by just a couple of weeks. If you believe you have a case suitable for the Commercial Court, you must act immediately. The same urgency applies as when seeking injunctive relief.

 

What to expect if your case is admitted

The Commercial Court sets out strict procedures and timetables for every stage of the case. Each party’s solicitor must give a personal undertaking to the Court that they have the capacity to handle the case and will comply with all directions. Failure to meet deadlines carries serious consequences — including costs being awarded against non-compliant parties. Clients must also allocate sufficient management time to properly engage with the process.

 

The Court actively encourages alternative dispute resolution (ADR), and the prospect of an early hearing date often facilitates early settlement. The Court has also adopted digital technology, enabling electronic filing and virtual case presentation.

How long does it take? As of December 2011, the average time to resolve a case in the Commercial Court was 22 weeks. 36% of cases are resolved within five weeks.

Costs

A €5,000 court fee is payable by the party seeking entry. If your application is refused, €4,940 is refunded, but your case will proceed through the standard Chancery division instead. Legal costs are substantial, as your legal team must prioritise your case above all others and your solicitor gives a personal undertaking to the Court on timelines.
